Leisure Centre Accidents and Gym Claims

Many people in the UK visit leisure centres and gyms and they are in general both fun and safe environments. This is because most organisers and managers have strict health and safety procedures in place. For example, when you sign up, most gyms will not allow you to use equipment without an induction, especially if you have not been a member of a gym before.

Unfortunately, some leisure centres and gyms neglect their duties resulting in accidents and injuries to its users. If this is the case (and the users are not at fault) then the users can make a claim for compensation against the owners of the gym or leisure centre (often the Local Authority). This is because they have a duty of care towards the health and safety of their users which should not be breached.

There are a number of accidents that can happen at gyms and leisure centres and the following are some typical examples:

  • Slips and Trips (on uneven surfaces, showers or by swimming pools)
  • Accidents by swimming pools due to no warning signs or the absence of a duty lifeguard
  • Gym injuries due to faulty or dangerous equipment or lack of training or an induction
  • Injuries caused by stray or falling objects or sports equipment

If you suffer in an accident at a gym or leisure centre then there are a number of procedures that you should follow to ensure that your claim has the best chance of success. The first and most important thing that you should do is to seek medical attention. Secondly, you should make sure that the accident is recorded by the leisure centre or gym in their accident book. Thirdly, (if possible) you should take pictures of the area where the accident took place (e.g. of the uneven surface) and note the details of any witnesses to the accident so that they can be approached at the time of the claim.

You should also seek legal advice from a personal injury solicitor as soon as possible and in any event bring your claim within three years from the date of the accident otherwise you may be prevented from doing so. We will endeavour to negotiate a settlement with the gym or leisure centre’s insurance company on your behalf or take the matter to court if liability is denied. We will also arrange for any of your expenses to be repaid to you (such as medical expenses or loss of income) and arrange ongoing medical care such as physiotherapy if required.
